1. Acceptance of Terms

By accessing or using SuperWaitlist ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SuperWaitlist provides a platform for creating and managing waitlists, including submission collection, email notifications, and real-time alerts via third-party channels (Telegram, Discord, Slack, webhooks). The Service is offered on a subscription basis with a free tier and paid plans.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate and current information during registration.

4. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited emails, or deceptive communications
• Collect data in violation of applicable privacy laws
• Violate any applicable law or regulation
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service

We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscriptions and Billing

Paid plans are billed monthly or annually in advance. Payments are processed via Dodo Payments. You authorize us to charge your payment method for all fees associated with your chosen plan. Subscriptions automatically renew unless cancelled before the renewal date.

Refunds are issued at our discretion. If you believe you were charged in error, contact us at support@superwaitlist.me.

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy. You are responsible for ensuring that any personal data you collect through your waitlists is done in compliance with applicable privacy laws (including GDPR where applicable).

7. Intellectual Property

You retain all rights to the content and data you create through the Service. We retain all rights to the Service itself, including its software, design, and branding. You grant us a limited licence to host and process your content solely to provide the Service.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, SuperWaitlist shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the Service.

Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

You may terminate your account at any time by cancelling your subscription and contacting us. We may suspend or terminate your account for violation of these terms, with or without notice. Upon termination, your data may be deleted after a reasonable retention period.

10. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the new terms.
